So one would think that the ACC will retain the rights whether or not ESPN chooses to extend the existing contract. It would seem to make the question of valuing the damages after 2027 considerably more difficult.
The unenforceable penalty argument is intriguing. Basically they're saying that since the GOR is out of proportion to the actual damages to the conference that it is legally unenforceable. If FSU prevails with that argument it is quite a bombshell to the status quo. It basically means it's open season four conference realignment.
Since we are screwed under the existing structure, anarchy is our friend, though, I'm not sure that existing P4 schools becoming more readily available really helps us.

If a half dozen teams leave the ACC, UConn has very good chance of being a replacement. ACC will make basketball a priority,ACC will not add UConn. They listed 10 or so possible candidates for expansion before adding the 3 Sucksateers and UConn isn’t even on their radar.
Only positive scenario for UConn is a total ACC implosion that results in essentially a reformation of the 2003 Big East Conference

Wouldn't this be against them? Part of their argument is that the ACC has failed their duty to adequately get the same rights money as the SEC and B1G and that they are stuck with the same rights fee till 2036. This kind of undermines that point until ESPN extends the dealESPN not having a guarantee to extend the deal past 2027 is HUGE. That is FSU's out right there.

Are they a signatory party though? Isn't the legally binding agreement between ESPN and the ACC and not the ACC members et al?Everything else aside, how the F#$% is it possible that a signatory party to a legally binding agreement is not allowed to have an executed copy of said agreement?
