Apparently he does mind if that tape is replayed over and over and over again. People seem to have forgotten what's on it.


As usual, the media looks for mud about Syracuse when it comes to this time of year. Notice how Fine filed his lawsuit last November. Just like the "allegations" about major violations - by the unnamed source in that CBS story, it crops up at a convenient time. It seems to me that Boeheim has made a lot of enemies in the media for his bullying, like Calhoun once did, and that this is media payback. Not everyone in the press is an SU grad.

Really, don't feel so aggrieved. The article addresses the time lag. Says the papers were filed but it wasn't until this Thursday that someone actually filed an information release. Unless the reporter is lying, no one actually asked for the papers until this week. Why did they ask for them? Likely because of the tournament. But that's a far cry from having the story and sitting on it. Very different.

But why in the world would Fine want people to relisten to that audiotape? That's insane.

Fine doesn't want this to go anywhere but a settlement. If it went to trial, he'd be tried in civil court.

Oy. Talk about no perspective. That program does not get an iota of the media scrutiny that UConn did under Calhoun. It's part of the reason your fans are able to delude themselves into thinking that Syracuse exists on some higher moral plane than UConn, when the reality of the situation is that you've got as lawless a program as there is.

Fine actually has a legitimate case - two-thirds of the "victims" ESPN interviewed ended up being full of crap, and the third one was pretty murky.

I don't think he'd win because, well, it's borderline impossible to win a defamation lawsuit as a public figure. But he appears to have enough of a case to bring this one to court (or, as temery mentioned, to receive a settlement).

To win a civil claim of libel as a public figure you need to prove that written statements were untrue, that the writer knew they were untrue when written, that false written statements were made with deliberate malicious intent and that ascertainable losses were directly sufferd (Sullivan v. NY Times).

Fine has no chance of proving all the above by a preponderance of the evidence. Difficult to understand why he filed lawsuit, who the heck has thought about him snce he 'left' SU program? Sometimes it is better to let sleeping dogs lie.

How close did you follow the case? First, ESPN didn't interview Tomaselli. His story was peddled elewhere. Schwartz stayed away. Do you know what the Chief of Police and DA said about Bobby Davis's story? Both of those guys are friends of Boeheim. They said Davis was credible and that they would have arrested Bernie Fine and charged him were it not for the statute of limitations. Did you listen to the audiotape? How can you say Fine has a legitimate case given the tape?

Not even close...you sound like a Syrabuse fan with that statement.
Two of the accusers were noted to be credible by the Syracuse Chief of Police, but because conveniently Syrabuse's contracted legal investigation found no evidence in 2003, in 2012 the Statute of Limitations had expired.
The third accuser was a troubled soul whose psychologist actually notified the authorities that he had been a victim. His story was not consistent and the investigation was eventually dropped. Clearly, he lied about either that he was abused or later lied when he withdrew his complaint but it is not at all clear which was the lie (perhaps a little alumni cash influenced the second statement?).
The fourth accuser appears to have been a lier from the beginning but that doesn't mean that the first two were not true victims....particularly when the phone conversation from Mrs. Fine certainly supports Davis's claim.
