My gut reaction is to agree with this. I haven't thought deeply about it, and I'm probably not informed or creative enough to do so anyway, but I can't see a way to define and enforce a cap. It's just way too big of a mess.
The NCAA still has control over programs though. They can likely require schools to disclose NIL payments and then if they find guys being paid under the table (like they have been for decades) the NCAA can investigate. They have to try something to keep it under control

The schools don't make the NIL payments, the 3rd parties/collectives do. Good luck getting a player to disclose their bank statements.
