Ah the dangers of random searches. These are D2 rules that clearly are wrong for D1. I wouldn't be surprised if they aren't accurate for D2 either.

okay, let's try this definition...

Guidelines for Medical Hardship Waiver Requests

For a student-athlete to receive a Medical Hardship Waiver per Bylaw 14.2.4, the following four conditions must be met:
  • The student-athlete may not have participated in more than two contests or dates of competition or 20 percent of the team's completed contests/dates of competition.
  • The injury or illness must occur prior to the completion of the first half of the season.
  • The injury or illness does not have to occur during practice/competition, but it must be incapacitating.
  • Appropriate medical documentation must exist and be provided.


All percentages are calculated according to contests or dates of competition, depending on how your sport's competitive opportunities are counted. Only contests or dates of competition occurring during the championship (traditional) season are included in the calculations. Conference championships/tournaments are counted as one contest or date of competition, regardless of the actual contest/dates used.


If the percentage calculation for the 20-percent rule results in a decimal -- any decimal -- the whole number preceding it is always rounded up. For example, if the softball team competes in 56 games, 20 percent of 56 is 11.2. Due to the "rounding-up," a softball team member who competed in 12 games does qualify for a medical hardship waiver.


To meet the first-half-of-the-season requirement, all competition must cease prior to the start of the contest or date of competition that begins the second half of the season. For example, a soccer player competing in the 10th game of a 19-game season does not qualify for a medical hardship waiver. Also, a student-athlete who is injured in the first half of the season, then attempts to play in the second half and aggravates the original injury, does not qualify for a medical hardship waiver.


NOTE: A STUDENT-ATHLETE RECEIVING A MEDICAL HARDSHIP WAIVER IS PERMITTED UNLIMITED PARTICIPATION IN THE NON-TRADITIONAL (NON-CHAMPIONSHIP) PORTION OF THE SEASON.

The post above is wrong as to its most important points. If you are going to randomly cut and paste things from random internet sites, why not go to the NCAA bylaws instead. One big problem is that incorrect 20% figure.

The figure is 30% that is old info. That is one problem with the internet. It does not clear out old and outdated info.

14.2.4 Hardship Waiver.

A student-athlete may be granted an additional year of competition by the conference or the Committee on Student-Athlete Reinstatement for reasons of “hardship.” Hardship is defined as an incapacity resulting from an injury or illness that has occurred under all of the following conditions: (Revised: 1/10/92 effective 8/1/92, 1/14/97, 8/1/97, 4/26/01 effective 8/1/01, 11/1/01, 4/3/02, 8/8/02, 3/10/04, 5/11/05, 9/18/07, 11/1/07 effective 8/1/08, 4/24/08)

(a) The incapacitating injury or illness occurs in one of the four seasons of intercollegiate competition at any two-year or four-year collegiate institutions or occurs after the first day of classes in the student-athlete’s senior year in high school;

(b) The injury or illness occurs prior to the first competition of the second half of the playing season that concludes with the NCAA championship in that sport (see Bylaw 14.2.4.3.4) and results in incapacity to compete for the remainder of that playing season;

(c) In team sports, the injury or illness occurs when the student-athlete has not participated in more than three contests or dates of competition (whichever is applicable to that sport) or 30 percent (whichever number is greater) of the institution’s scheduled or completed contests or dates of competition in his or her sport. Only scheduled or completed competition against outside participants during the playing season that concludes with the NCAA championship, or, if so designated, during the official NCAA championship playing season in that sport (e.g., spring baseball, fall soccer), shall be countable under this limitation in calculating both the number of contests or dates of competition in which the student-athlete has participated and the number of scheduled or completed contests or dates of competition during that season in the sport. Dates of competition that are exempted (e.g., alumni contests, foreign team in the United States) from the maximum permissible number of contests or dates of competition shall count toward the number of contests or dates in which the student-athlete has participated and the number of scheduled or completed contests or dates of competition in the season, except for scrimmages and exhibition contests that are specifically identified as such in the sport’s Bylaw 17 playing and practice season regulations. Scrimmages and exhibition contests that are not exempted from the maximum permissible number of contests or dates of competition may be excluded from the calculation only if they are identified as such in the sport’s Bylaw 17 playing and practice season regulations; and

(d) In individual sports, the injury or illness occurs when the student-athlete has not participated in more than three dates of competition or 30 percent (whichever number is greater) of the maximum permissible number of dates of competition as set forth in Bylaw 17 plus one date for a conference championship (e.g., gymnastics: 13+1=14, wrestling: 16+1=17), regardless of whether the team participates in the conference championship, provided the institution is a member of a conference and the conference holds a championship event in the applicable sport. Dates of competition that are exempted per Bylaw 17 (e.g., alumni contests, foreign team in the United States) from the maximum permissible number of dates of competition do not count toward the number of dates in which the student-athlete has participated.

14.2.4.2 Administration of Hardship Waiver.

The hardship waiver shall be administered by the member conferences of the Association or, in the case of an independent member institution, by the Committee on Student-Athlete Reinstatement. (Revised: 10/28/04, 4/20/09)

14.2.4.2.1 Review of Denied Waiver.

A conference that denies an institution’s hardship waiver may submit the waiver to the Committee on Student-Athlete Reinstatement. The committee shall have the authority to review and determine whether to approve the waiver based on circumstances that may warrant relief from the application of the legislated waiver criteria. (Adopted: 4/20/09)

14.2.4.3.3 Medical Documentation.

Contemporaneous or other appropriate medical documentation, from a physician (a medical doctor) who administered care at the time of the injury or illness, that establishes the student-athlete’s inability to compete as a result of that injury or illness shall be submitted with any hardship-waiver request. (Adopted: 4/20/99, Revised: 2/22/01)

What you posted is not from the current D1 bylaws. To find the current ones simply go to NCAA.org, then D1, then governance. Randomly posting links to misinformation does not help even if your intentions are good.

John was on the right track but unfortunately made a major blunder when he said "Tuck likely straddled the fence when it comes to eligibility for the waiver, both in terms of the number of games she’s already played and the fact three were in January."

The rules are very specific on these calculations and she did NOT straddle the fence at all. Unfortunately he left out the part of the bylaws that tell exactly how to do the calculation.

Yes, John was not articulate on the January thing.

I posted his article because the specific NCAA/AAC rules were at the bottom om the blog entry along with updates.

Unfortunately, with the rules posted as is it would appear Morgan would be ineligible for medical waiver playing in game 16 of the qualified 31 games of the regular season. There is some wiggle room in the language if interpretation is allowed but it is far from clean.

Well, since it seems I'm out of my league in the knowledge department, and my attempt at enlightenment has been met with some comments of distaste for that attempt (as honest as they were), I will just be quiet and stay out of the way. No harm, no foul, no offence.

REading that crap is like trying to read the health care law - obviously, bureaucrats at work (or not) in both instances.

In any event, I thought the magic numbers were 31 reg season games plus 1 allowed for post-season, equals 32......her last appearance was in game 16, which falls in the FIRST half of a 32 game allowance. Ready to stand corrected....or confirmed....as always.

That is why John's blog post was dangerous. There is NO wiggle room and NO interpretation allowed in the rules - they are very specific and very clear. It's just he didn't read or post the relevant part of the rules. They specifically state that the "first half of the season" is determined by the team's total regular season games PLUS one more for a league tournament - meaning the UConn figure is 32 games. So 16 games is clearly in the first half. No interpretation needed - the rule is clear. Likewise for her having played in less than 30% of the team's games, since 32 games x 30% = 9.6 games (rounded to 10 under the rules), and she only played eight.

They wiggle room occurs in the phrase "when the injury occurred." Morgan 's last game is unrelated to the timing of the original injury which was prior to the second half. So, yes, there is interpretive space in the phrasing.
