UConn starting to get respect.

Notre Dame games are not conference games.
The plan is for 16 teams to play 9 conference games plus 1 P4 game per year. The 17th team will play 8 conference games plus 2 P4 games. The ACC winner will be first based on winning percentage and then there are other measures to consider if two teams tie on that measure. The biggest change is all of the P4 conferences will play less G5 teams in the near future since all going to 10 P4 games per year.

Notre Dame games are not conference games.

Edit to add that the confusion may come from the fact that the ND-Clemson 10 year agreement counts towards ND 5 game ACC scheduling agreement. But those 5 games are not conference games.
One addendum to this:

Currently ND games against ACC schools do not count as conference games. The idea was floated that once the ACC goes to a nine game conference season, counting the ND games as conference games could be a solution to having an odd number of football schools.

There were some early complaints about this (under the belief that it would be extremely unfair to some schools), so adding an additional member (for either football or all sports) would be the alternative.

One advantage we have over other potential additions is that we could slot in as a football only under a temporary agreement. Not a perfect scenario for us, but potentially a a path to what we want.
