NLRB: Football players at private FBS schools..employees


The NLRB does not have jurisdiction over public schools, so the ruling by NLRB general counsel Richard F. Griffin Jr. only affects football teams at private FBS schools. Those universities are Baylor, Boston College, Brigham Young, Duke, Miami, Northwestern, Notre Dame, Rice, Southern California, Southern Methodist, Stanford, Syracuse, Texas Christian, Tulane, Tulsa, Vanderbilt and Wake Forest. The original case dealt with the Northwestern football team, so Griffin did not have jurisdiction beyond that sport."

Break out the affected teams into a separate league...

East:

Notre Dame, Boston College, Duke, Miami, Syracuse, Vandy, Wake Forest, Tulane

West:

Rice, So Cal, SMU, Stanford, TCU, Tulsa, BYU, Baylor

General counsel gets replaced in November.

Bottom line is if players at private schools fight for pay, non revenue sports get axed.

The new ruling can be challenged in court. The Northwestern ruling was challenged, and the NLRB director lost.

At the end of the day, the universities need only make a good faith effort to get the NCAA to allow them to be paid. A very low bar if you are 17 of 128 FBS schools. The worst case for the schools is to kick out the private schools should the NCAA feel threatened in the least, which they won't be.

Bottom line is if players at private schools fight for pay, non revenue sports get axed.

They don't have to get axed, the school should just decide whether or not this sport means enough to warrant scholarships or not. Was done that way before football & basketball subsidized everything.
