Will guess Florida, in which juries don't decide punishment, they make a recommendation to the judge, who makes the actual decision, though the U.S. Supreme Court just agreed to decide whether Florida's system is constitutional. (Then there are states like Arkansas in which judges can "override" a jury's decision, an option judges often use when the jury returns with a non-death verdict.)
