OT aunt sues 12 year old nephew

What a b!tch. Kid's mom died last year. Probably trying to squeeze a little money out of the will/life insurance policy.
 
There's a special place in hell for this woman. Sorry little Sean, but Auntie Jen is count-cun-tula.
 
To top it off, the mom committed suicide in may of 2014.
 
So I did a little googling because it's so odd. Yeah, it's even odder after that.

I guess it could be someone trying to get a taste of some life insurance money, but I would venture that it's way more dramatic than that.

In general, you have to allege negligence in order to have homeowner's insurance cover a claim like this. Intentional acts, like assault, would not be covered. And the kid is held to the standard of reasonable behavior for an 8 year old. One hopes that the jury comes back with a defense verdict in 20 minutes, the fact they are at trial means either no offer was made or the plaintiff is rolling the dice for more money than it being offered.
 
What's that poor woman supposed to do? Back in the day if the kid knocked her on her he'd get a whooping by somebody, most likely the father. But now with every kid in the world one cell phone call away from having the aunt and parents put in jail she has no other recourse.
It's sue or be sued, that's the American way in 2015 ;)

You've got the father's sister suing the kid. It seems to me it's a lot more likely those two siblings are trying to get at money that is locked up in a trust for the kid - than she is making some kind of legitimate claim.

Note she didn't sue her brother in the multiple years post injury pre mother's suicide.

I'm with you - I was thinking along the same lines. The sister wants in on the trust fund. But if this is a clue how the family operates, you have to revisit the original suicide for foul play.

It's not even completely clear she committed suicide. The only obit I can find is in a paper in England and gives no details.

There is a memorial annoucement that asked for donations to a suicide charity and a domestic violence charity.

Who knows - the sister might be trying to get at the money for a good reason because the father is a dirtbag.

I think the over the top nature of the claim makes it impossible to decide she is just making a ridiculous claim for some money.

Please tell me you are joking. She had 2 years from the date of the injury to bring a lawsuit, which typically take a couple of years to reach trial if it doesn't settle. The child is being sued as the negligent actor, the father could have been sued under a theory of negligent supervision, etc., but it wasn't necessary. The judicial website gets locked down on cases that are on evidence, otherwise I could get a better idea of whether an insurance company is defending the child (through dad's homeowner's policy) if I could see what firm is involved. Sure, it's a money grab, but for insurance money. Which everyone for some reason thinks is free. The most likely scenario is the insurance company, which gets to decide how to defend or pay this, told her lawyer to piss up a rope.

It's a very high probability it's a scam.

I just see the DUI followed by what looks like a suicide and memorial contributions to domestic violence charities combined with the ridiculous nature of the claims... and think it might be more complicated than a straight insurance scam.

All the other stuff could be coincidental but that's a lot of pretty serious coincidences.
 
The more I read, the more stupid I think Aunty Jen is.

  • “I was at a party recently, and it was difficult to hold my hors d’oeuvre plate,” - she failed to mention how difficult it was to hold her glass of Moet & Chandon at said party. That fact could have swung the jurors.
