I would think that money is pretty hard to collect without a contract, no matter what Hamilton said. He wasn't promising them his money, so he was not in a position to deliver it. The fact that they did not understand the difference is generally not relevant in these kind of payment disputes. Seller beware in the NIL world.

Based on the article, it would be hard to collect. They don't claim anyone used their name, image or likeness. Just that the promise induced them to play at FSU, but that's not the services in an NIL contract.

That said, you have to imagine Hamilton is gone soon. He's the oldest guy left in the ACC, they've been trending down, and now he's getting sued for breaking NIL promises. It's going to be tough/impossible for him to recruit.

I'm not sure what happened with Hamilton's
"business partners," but I can see this becoming an easy way for wealthy alums to get rid of coaches they don't like. They used to need to help pay the buyout, now they'll just hold back their promised NIL contributions.

Doesn’t change the buyout calculus. If coach has a contract unless he breaches the contract, they are on the hook to pay him.

I think we're going to hear more stories like this. The first one was that UNLV QB. The way NIL is handled is so messed up.

Yup. I just got lazy and didn't fully finish my thought. Basically that NIL gives more power to the wealthy fans (I shouldn't say they are alums) to force a move. A struggling coach with a buyout could possibly get another year or two to right the ship. A struggling coach with no NIL is dead.

I would imagine this sort of thing happened pre-NIL, but we just didn't hear about it for obvious reasons.

The whole thing with third party funders does get you thinking.

I seem to remember when they were in the process of finalizing Hurley’s current contract, he mentioned that one of the details related to NIL. (which I either remember reading, or maybe inferred, concerned a certain level of guarenteed support so he could be assured of being able to recruit competitively)

It made perfect sense to me at the time, but thinking about it how can the University guarentee that NIL funding will be there if they’re not directly providing it?

Anyone else remember something to this effect regarding the Hurley contract?

NIL is strange because 99% of the players are not being paid by companies for traditional endorsement purposes such as bringing more attention to a brand or product. They are being paid by fans and donors or companies that know there is no return on the investment.

It’s easy to think that this won’t continue but college sports culture is crazy so there’s a good chance the prices grow even bigger.

I think alumni are going to lose momentum on NIL over time. The ROI to the alumni is not great. I could see corporations and the like continuing to pay for it long term, but I think this may be the peak compensation of the NIL era.

I don't see how the players have any case legally. This stuff isn't at all in the spirit of NIL and there aren't real contracts. It's boosters paying kids to play and you're going to see players paid based on how good they are. If they aren't good obviously some of these boosters aren't going to pay them.

Its all kind of facinating since one of the few rules that the NCAA made was that NIL couldn’t be used as an inducement for a player to attend a certain school.

Of course that’s exactly what its used for, but it seems neither side is eager to test this out in court, so everyone keeps silent on any details about how the whole NIL thing actually works (and it probably varies from school to school)

Anyone that really knows, keeps their mouth Shut.

Soon Pitino will be the last 70+ year-old coach left standing. The sewer of NIL is like a vacation resort for him.

Edit: I thought coaches couldn't promise NIL? (at least based on the deal from the Fall where that QB portaled after he said coach failed to deliver $100k NIL). I don't think that lawsuit will hold up unless they sue the university, not Hamilton.

LOL. While the Wild West NIL world will age everyone else more rapidly, and burn them out, Pitino will get younger looking and more energetic each year.

I think the players would settle for the character assassination of Hamilton, any money is gravy considering you never got it in the first place.

Sad it’s come to this, I would rather just see some sort of revenue sharing, where if a team makes x amount of money the players on the team get a share of that, with players with larger roles getting a bigger share.

I also wished the NBA worked like that.
