Refs seem to give a lot of leeway setting up 3 point attempts, but sometimes are really picky on drives. I don't understand why the inconsistency. And they allow a bunch of bunny hops on post ups sometimes too (that really isn't what you asked me about; I guess the point is refs have more or less been ignoring the rules as they see fit for quite a while).
