Whole lot of he said--they said--truth some where else. To chime in on the outside looking in--is stupid--so I'll chime on the TRANSFER aspect-
The NCAA, from a moral position, if not a legal one, if they allow Any one to play without sitting--regardless of the reason--has an obligation to allow all transfers to play immediately.

Who knows how this will turn out, but there it is not an easy path for him to prove because the transfer rules do not prevent a player from receiving a scholarship for the sit-out year and there is never a guarantee or 'right' to play basketball in NCAA competition.

Definitely not an easy path. As you say, the athlete is not prevented from receiving a scholarship. Also in most cases the athlete is still allowed to play for the same number of years i.e. four. One element of the NCAA's position is that the rule prevents potential chaos in the major scholarship sports. Imagine a program where ten players transfer out in one season. Also the rule helps keep poaching under a bit more control.
