Off Topic?: clemson versus acc filing

Definitely not off topic! Similar to FSU’s case. Claims the GOR’s financial terms represent a penalty and therefore not enforceable.

Would a court typically rule on a declaratory judgment for a case like this, or would it only rule on an actual lawsuit, if one party claims a breach actually occurred? It seems the court might just say we're not ruling anything about your contract, that's between you two. Now if there is an accusation of a breach, file a lawsuit. It seems this case is very complex and no matter what the court would rule, it would be appealed anyway if that is part of the process. Looks like it is going to be a loooooong process.
 
It would be nice if North Carolina and Virginia would file their own lawsuits.
legal question: what's the point? I mean, if someone is already out there making the arguments, why does anyone need to file a suit? it would be one thing if Clemson did an amicus supporting FSU, but they filed a whole new lawsuit.
