I posted a while back that there is more than a little confusion as to what can and cannot be divulged by an institution pertaining to their athletes. At the time, I said that students routinely give permission (but cannot be required to give it) for grades and injury information to be shared, typically with the mass media. Schools sometimes bundle this consent form with their LOI agreements. Some do not. For those interested, I've located this fairly short article that seems to have it right.

Some believe because these students are over 18 their health and grade records are open for all. Typically Medical Privacy is only given up to a physician or facility that will perform those services on that person. And that must be given by written consent.
I would never allow my child to "give away" the privacy of their Medical records to anyone outside of the persons currently working on them. Nor would I go along with grades being publicly exposed--good or bad.

The legality of any situation can only be adjudicated in court. If laws were cut and dried --you'd only need judges not lawyers.

Smile and get your way!! Good advice unless one of your players has a next door neighbor who is a federal judge or a sister who is an attorney~??

All judges are different and different states have different views on the same subjects. Take nothing as fact until a judge says it's fact.

Don't the athletes' scholarship agreements give permission to the school, or coach, to divulge publicly health/injury issues which affect the player's availability or ability to play?

Often, yes. But not always. Most any agreement (or contract if you prefer) is subject to the laws of the respective states, and can be variously amended if both parties agree to something more, less, or different.

The collgiate program I am closest to does get a situational disclosure agreement from the athletes. They have never said anything much about it. It is just part of their life as an athlete. I can't make it more complicated than that.

Well if your child is 18+, you really have no say.
