BOISE, Idaho -- Boise State is asking a judge to declare that the school does not owe a $5 million penalty for cancelling its entry into the Big East Conference last year.

The university announced Monday it had filed a lawsuit in 4th District Court in Boise after a representative of what will soon be the American Athletic Conference said the conference intended to sue the university.

Boise State signed an agreement in December 2011 to join the Big East in 2013 for football. However, the school says the conference lost three-quarters of its membership over the next year, failed to add more football schools west of the Mississippi and lost its guaranteed spot in BCS bowls. In December, Boise State opted to stay in the Mountain West Conference for all sports.
University president Bob Kustra argues the conference the Broncos agreed to join no longer exists.
"Boise State entered into that agreement in good faith and with a great degree of optimism, but the conference we agreed to join simply no longer exists," Kustra said.

Big East officials say the lawsuit is disappointing, but that they are confident the university will have to pay the cancellation fee required in the contract.

"We are disappointed that Boise State has gone to court to try to avoid the contractual obligation that it made to the Conference to pay $5 million for refusing to join after committing to do so," Big East commissioner Michael Aresco said in a statement.

Don't these sorts of legal agreements always have a jurisdiction clause which states if there is a conflict or disagreement, that's the court which shall be used? I highly doubt that the Big East would allow someone like Boise St. to specify a venue like Boise for such an agreement. Just crazy - something happens that you don't like, just sue in your home state to get out of the commitment.

This part is such a line of bull. Yes, we lost 3/4 of our members. However, was there a clause in their agreement stating that more schools west of the Mississippi would be added? If not, too freaking bad. Pay the exit fee and go back to the MWC. As for the BCS bid, The Big East/AAC did not actually lose it. Technically, EVERY conference lost their automatic qualifying bid. The only thing the AAC lost was a guaranteed spot into a big money bowl. If I recall the playoff correctly, there are no conferences with automatic spots in there. Only the top 4 teams, correct?

This whole thing is silly. Use some of the money that you suckered the MWC to allow you to keep in order to come back to the MWC and pay the $5 mill. We'll see you in 2014

Can't wait to kick their asses in 2014.... and thanks for even more money.... god USF CINCY and UCONN are making away like bandits with these entrance and exit fees LOL
